1. Introduction

Welcome to Unwritten Occasions. These Terms and Conditions outline the rules and regulations for the use of our services. By engaging with Unwritten Occasions for event planning, management, decor, and equipment hire, you agree to comply with the following terms and conditions.

2. Definitions

  • Client: The individual or organisation booking services from Unwritten Occasions.
  • Services: Event planning, management, decor, and equipment hire provided by Unwritten Occasions.
  • Equipment: Items hired out by Unwritten Occasions, including but not limited to LED lights, selfie pods, crisp walls, donut walls, audio guestbooks, and decor items.
  • Event: The occasion for which the Client has booked services and/or equipment.
  • Contract: The agreement between Unwritten Occasions and the Client based on these Terms and Conditions.

3. Services

Unwritten Occasions provides event planning, management, and decor services, including room dressing for weddings, special occasions, and corporate events. We also offer equipment hire as part of our packages.

4. Booking and Payment

4.1 Deposits

  • A non-refundable deposit is required to secure your event date and services. The deposit amount will be specified in your service agreement.
  • The deposit must be paid within 7 days of the booking confirmation to secure the date.

4.2 Final Payment

  • The balance is due 6 weeks before the event date.
  • Failure to complete payment by the due date may result in the cancellation of services without refund.

4.3 Cancellations

  • Cancellations must be made in writing.
  • Cancellations made more than 6 weeks before the event will incur a 50% charge of the total booking amount.
  • Cancellations made less than 4 weeks before the event date will incur a 100% charge of the total booking amount.

5. Changes to Services

5.1 Changes by the Client

  • Any changes to the scope of services, including guest numbers, event date, or location, must be communicated in writing.
  • Changes may be subject to additional charges and must be confirmed at least 4 weeks before the event.

5.2 Changes by Unwritten Occasions

  • We reserve the right to make minor changes to the services if necessary, without prior notice, provided they do not materially affect the nature or quality of the services.

6. Liability

6.1 General Liability

  • Unwritten Occasions shall not be liable for any indirect, special, or consequential damages including, but not limited to, loss of profits or revenue, loss of use, or replacement costs.

6.2 Force Majeure

  • Unwritten Occasions shall not be liable for any failure to perform its obligations where such failure is a result of Acts of God, war, civil unrest, government actions, or any other event beyond our reasonable control.

7. Equipment Hire

7.1 Damage and Loss

  • The client is responsible for any damage to or loss of hired equipment from the time of delivery until collection.
  • A damage deposit may be required for certain items, refundable upon safe return of the equipment in good condition.

7.2 Setup and Collection

  • Delivery, setup, and collection times will be agreed upon in advance.
  • It is the client’s responsibility to ensure that the venue is accessible and available at these times.
  • Delays caused by the client or venue may incur additional charges.

7.3 Use of Equipment

  • The client must ensure that the equipment is used properly and safely.
  • Any misuse, alteration, or unauthorised movement of the equipment will result in additional charges and possible cancellation of services.

8. Third-Party Vendors

8.1 Recommendations

  • While Unwritten Occasions may recommend third-party vendors, we are not responsible for their performance of services.

8.2 Contracts

  • Any contracts with third-party vendors are directly between the client and the vendor.
  • Unwritten Occasions is not liable for any issues arising from third-party services.

9. Intellectual Property

  • All materials provided by Unwritten Occasions, including designs, proposals, and digital content, are the intellectual property of Unwritten Occasions and may not be reproduced without permission.

10. Privacy

  • We are committed to protecting your privacy. Personal information collected is used only for the purpose of providing our services.
  • Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

11. Amendments

  • Unwritten Occasions reserves the right to update or amend these Terms and Conditions at any time without prior notice.
  • The latest version will always be posted on our website.

12. Governing Law

  • These Terms and Conditions are governed by the laws of England.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of that location.

13. Insurance

  • The client is advised to take out insurance to cover any potential damages, losses, or liabilities that may arise during the event.

14. Health and Safety

  • The client is responsible for ensuring that the venue complies with all health and safety regulations.
  • Unwritten Occasions will conduct a risk assessment where necessary but is not liable for the safety of the venue or attendees.

15. Data Protection and GDPR

  • Unwritten Occasions complies with the General Data Protection Regulation (GDPR).
  • Clients are responsible for ensuring compliance with GDPR regulations when using our services.

16. Termination

16.1 By Unwritten Occasions

  • We may terminate the contract if the client fails to comply with any of its obligations under these terms.
  • Termination will be effective immediately upon written notice to the client.

16.2 By the Client

  • The client may terminate the contract subject to the cancellation terms outlined in section 4.3.

17. Notices

  • Any notice required to be given under these Terms and Conditions must be in writing and sent by registered or recorded delivery mail.
  • The client’s address for the service of notice shall be the address stated on the Booking Form.
  • Any changes of address must be notified and acknowledged to be deemed valid.

18. Entire Agreement

  • These Terms and Conditions constitute the entire agreement between the parties and supersede any prior agreements, understandings, or arrangements.

19. Severability

  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

20. Waiver

  • No waiver by Unwritten Occasions of any breach of these Terms and Conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.

21. Indemnity

  • The client agrees to indemnify and hold Unwritten Occasions harmless from any claims, damages, losses, or expenses arising out of or related to the client’s use of our services.

22. Dispute Resolution

  • In the event of a dispute, both parties agree to attempt to resolve the matter through mediation before pursuing legal action.
  • If mediation fails, the dispute will be resolved by the courts of England.

23. Copyright and Media Use

  • Unwritten Occasions will own the copyright of all images and videos taken using our equipment.
  • We reserve the right to use these images for promotional purposes unless explicitly requested otherwise by the client in writing before the event.

24. Venue Access and Setup Requirements

  • Clients must ensure that the venue provides appropriate access and space for the setup and operation of our equipment.
  • Any delays or issues arising from venue restrictions are the responsibility of the client and may incur additional charges.
